Wetlands Permitting

Policy for Submitting Forms to the Conservation Commission

Please submit two paper copies of all permit applications in addition to one electronic copy of the application and any supporting documents in PDF format. Electronic documents can be submitted via email or CD/USB format.  

WPA Form 1: Request for Determination of Applicability (RDA)

This form enables the applicant to seek a determination of whether the provisions of the Wetlands Protection Act apply to a particular land area, determine the boundaries of a wetland resource area, or other circumstances under which proposed work would be regulated by the Act.  The filing will be reviewed at a Public Meeting of the Conservation Commission. 

Filing Instructions

  1. Prepare the WPA Form 1 (PDF version) for submission to the State DEP and the Town. Click here for State website and instructions. WPA Form 1: Request for Determination of Applicability
  2. Submit two copies of WPA Form 1 and two copies of plans for the project (Either Engineered plans or detailed sketch) to the town.  The town copy must be printed and mailed or dropped off at the Conservation Office.  Town fees are $50 permit fee and $110 legal ad fee separate checks made out to the "Town of Upton".

WPA Form 3: Notice of Intent (NOI)

The Wetlands Protection Act prohibits the removal, dredging, filling, or altering of wetlands without a permit. A Notice of Intent is required to obtain such a permit. Click here for more detailed Upton applicant instructions and note NOI documents to the right.

WPA Form 3: Wetlands Notice of Intent

WPA Form 4A: Abbreviated Notice of Resource Area Delineation (ANRAD)

This form provides a procedure for an applicant to confirm the delineation of a bordering vegetated wetland and also serves as an application for a simplified review of projects located in a buffer zone.

WPA Form 8A: Request for Certificate of Compliance

Upon completion of work authorized in an Order of Conditions, the property owner must request a Certificate of Compliance from the issuing authority (Mass DEP or the Conservation Commission) stating that the work has been satisfactorily completed.
